Congresswoman Anna Paulina Luna has introduced the “Do or Dye Act,” aiming to address concerns about synthetic dyes in food products. The legislation seeks to eliminate certain petroleum-based dyes that are prevalent in foods, particularly those marketed towards children.
“For too long, the FDA has turned a blind eye while toxic, petroleum-based dyes like Red 40 and Yellow 5 have flooded our grocery shelves—often in foods marketed directly to kids,” said Rep. Luna. “The Do or Dye Act puts an end to this insanity and takes real action to protect American families. It’s time we stop feeding our children chemicals that are banned in other countries. Let’s Make America Healthy Again.”
The proposed act includes a complete ban on Citrus Red No. 2 and Orange B by the end of 2025, along with a phased elimination of Green No. 3, Red No. 40, Yellow No. 5, Yellow No. 6, Blue No. 1, and Blue No. 2 by December 31, 2026. It also aims to codify Secretary Kennedy’s food safety directive into federal law and addresses concerns regarding artificial dyes’ effects on child development and health.
There is growing bipartisan support for cleaner food standards as scientific evidence links synthetic dyes to hyperactivity, allergies, and potential carcinogenic effects.
Secretary Kennedy’s initiative for phasing out these dyes has gained widespread industry backing from major companies such as PepsiCo, Danone North America, TreeHouse Foods, and Tyson.
“This is not a partisan issue. It’s a parenting issue, a public health issue, and a common-sense issue,” Luna stated further emphasizing the importance of legislative action due to clear scientific evidence and public demand for change.
